Your 5 basic rights as a California worker

All workers have certain rights in California. You might be a CEO born and raised in California, or an undocumented agricultural worker who has been in the country for 6 months. But you have the same basic rights, regardless of your legal status.

You must have a good understanding of your rights as a worker. This is so that you can take the appropriate action if your rights are violated, and so that you can take a stand with confidence. The following are the 5 basic rights you have as a worker in California.

Rest and meal breaks

You are entitled to a 10-minute rest break for every 4 hours of work, and a 30-minute meal break for every 5 hours of work.

Minimum wage and overtime

All employees are entitled to minimum wage, which is currently set to $12 per hour for companies with 26 or more employees. Some employers try to get around this by registering their employees as independent contractors, so you should ensure that you are classified as an employee.

Safe and healthy jobs

You have the right to only work in safe conditions that do not pose a risk to your health.

Taking action without retaliation

If you make a complaint about workplace safety or discrimination, for example, you have the right to not be punished by your employer for this.

Unemployment and injury compensation

If you are injured at work, you have the right to workers' compensation. If you become unemployed, you can take action to claim unemployment benefits.
